Welcome to StayintheGorge.com (“Site”), operated by Stayed LLC (“Stayed,” “we,” “our,” or “us”).
By accessing or using the Site or booking a stay through us, you agree to these Terms of Service (“Terms”).
If you do not agree, please do not use the Site.

1. Services

Stayed provides information and booking services for short-term cabin rentals in the Red River Gorge area and related hospitality services.

2. Eligibility

You must be at least 18 years old and capable of entering into a binding contract to use the Site or book a stay.

3. Reservations & Payments

  • Booking Platform: Reservations and payments are handled through third-party service Hospitable (and may include Stripe). Your booking is not confirmed until you receive a written confirmation email.

  • Security Deposit: A security-deposit hold may be placed on your payment method and charged only if damages occur.

  • Rates & Fees: Prices, taxes, and fees are listed at the time of booking and may change until a reservation is confirmed.

4. Cancellations & Refunds

Cancellation and refund policies are stated during checkout and in your confirmation email. Those terms are part of this Agreement.

5. Guest Responsibilities

  • Follow all house rules provided in your booking confirmation.

  • Use the property for lawful purposes only and keep it in good condition.

  • You are responsible for the conduct of all guests and visitors during your stay.

6. Acceptable Use of the Site

You agree not to:

  • Violate any applicable laws or regulations.

  • Access or use the Site to harm or interfere with its operation or security.

  • Attempt to copy, scrape, or reverse-engineer the Site’s software.

7. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect and use your information.

8. Third-Party Services

We may link to or integrate with services such as Hospitable, Stripe, Twilio, Brevo, Google Analytics, and Facebook.
We are not responsible for the privacy practices or terms of those services.

9. Intellectual Property

All content on the Site—including text, graphics, logos, and software—is owned by Stayed or its licensors and protected by copyright, trademark, and other laws.
You may not use our content without written permission.

10. Disclaimers

  • The Site and services are provided “as is” and “as available.”

  • We make no warranties about accuracy, availability, or suitability for a particular purpose.

11. Limitation of Liability

To the maximum extent permitted by law, Stayed LLC is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or your stay, even if advised of the possibility of such damages.
Our total liability will not exceed the amount you paid for your booking.

12. Indemnification

You agree to defend, indemnify, and hold harmless Stayed LLC, its owners, and employees from any claims or damages related to your use of the Site or your stay.

13. Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-laws rules.
Any disputes will be resolved in the state or federal courts located in Scott County, Kentucky.

14. Changes to These Terms

We may update these Terms at any time.
The new Terms will be posted on this page with the “Effective Date” updated.
Continued use of the Site after changes means you accept the new Terms.
